Terms of Service

The terms that govern our AI automation and CRM implementation services for remodeling companies.

1. Acceptance of Terms

By accessing the SmartSiteSystems website, submitting a form, booking a consultation, or engaging our services, you agree to these Terms of Service. If you do not agree, please do not use our website or services. These terms apply in addition to any signed service agreement, which controls in the event of a conflict.

2. Services Provided

SmartSiteSystems is a professional AI automation and CRM implementation company serving kitchen and bath remodeling businesses. Services may include AI reengagement campaigns, AI SMS and email follow-up, missed-call text back and AI receptionist workflows, appointment booking automation, CRM setup and pipeline configuration, website conversion audits, reporting, and related consulting and training.

The specific scope, deliverables, and timelines for your engagement are defined in your proposal or service agreement. We may improve or modify our platforms and workflows over time provided the agreed outcomes are not materially reduced.

3. Client Responsibilities

Clients agree to provide timely access to lead data, CRM and calendar systems, phone numbers, domains, brand assets, and approvals required to deliver the services. Clients are responsible for the accuracy and lawful ownership of any contact data provided, for obtaining appropriate consent from their own contacts, and for complying with all applicable marketing, telemarketing, SMS, and privacy laws in their jurisdiction.

Clients are responsible for reviewing and approving campaign messaging before launch and for responding to qualified opportunities generated by the system.

4. Payment Terms

Fees, billing frequency, and any onboarding charges are set out in your proposal or service agreement. Monthly subscriptions are billed in advance and are non-refundable except where required by law. Third-party platform, messaging, telephony, and advertising costs are the client's responsibility unless expressly stated otherwise.

Late payments may result in suspension of services. Either party may cancel a month-to-month engagement with written notice prior to the next billing date.

5. Intellectual Property

All templates, prompts, automation frameworks, workflows, documentation, software configurations, and other materials developed by SmartSiteSystems remain our intellectual property. Clients receive a non-exclusive, non-transferable license to use these materials for their own business during the term of the engagement.

Client-provided content, brand assets, and customer data remain the property of the client.

6. Limitation of Liability

To the maximum extent permitted by law, SmartSiteSystems' total liability arising out of or relating to the services shall not exceed the fees paid by the client in the three months preceding the claim. We are not liable for indirect, incidental, consequential, or lost-profit damages, or for outages, errors, or actions of third-party platforms.

7. Disclaimer of Guarantees

SmartSiteSystems does not guarantee specific results, revenue, appointment volume, close rates, or return on investment. Outcomes depend on factors outside our control, including lead quality, market conditions, pricing, sales capability, and speed of client follow-up. All services are provided on an as-is and as-available basis.

8. Confidentiality

Each party agrees to keep confidential any non-public business information, pricing, customer data, and system configurations disclosed during the engagement, and to use such information only for the purpose of delivering or receiving the services. These obligations survive termination.

9. Account Termination

We may suspend or terminate services if a client breaches these terms, fails to pay, uses the services unlawfully, or uploads contact data obtained without proper consent. Upon termination, access to automations and hosted systems ends, outstanding fees become due, and client data will be exported on request within a reasonable period.

10. Governing Law

These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Any dispute shall be brought in the state or federal courts located in Ohio, and both parties consent to that jurisdiction.
